2. Eligibility and Age Requirements

- European Union/UK: You must be at least 16 years old to use this Service
- Other Jurisdictions: You must meet the minimum age required by your local laws
If you are under 18 (or the legal age of majority in your jurisdiction), you may only use this Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

4. User Accounts and Responsibilities
Account Creation and Accuracy
You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy. Providing false information constitutes a breach of these Terms and may result in immediate termination of your account.
Account Security
You are solely responsible for:
- Maintaining the confidentiality of your password and account
- All activities that occur under your account
- Immediately notifying us of any unauthorized use or security breach
- Ensuring your account information remains current and accurate
User Responsibilities for Content
You are solely responsible for:
- The accuracy and legality of all content you create or upload
- Ensuring your content does not infringe on any third-party rights
- Compliance with all applicable employment and anti-discrimination laws
- The consequences of using AI-generated content in job applications
- Backing up your important data (we recommend regular exports)
5. Payment Terms, Subscriptions, and Refunds
Subscription Plans
- Free Tier: Limited features and templates
- Premium Monthly: Billed monthly, cancel anytime
Billing Practices
- All payments are processed securely through Stripe
- Subscriptions automatically renew unless cancelled
- Prices are subject to change with 30 days notice
- Applicable taxes will be added based on your location
- Failed payments may result in service suspension
Refund Policy
- 7-Day Money-Back Guarantee: Full refund within 7 days of initial subscription
- No refunds for: Partial months, used services, or after 7 days
- Cancellation: Cancel anytime; access continues until end of billing period
- Disputes: Contact hello@resumeloom.com within 30 days
Promotional Offers
Promotional pricing is valid only for the specified period. After promotion ends, regular pricing applies unless cancelled.
6. Acceptable Use Policy and Code of Conduct
You agree to use ResumeLoom only for lawful purposes and in accordance with these Terms. You specifically agree NOT to:

- Violate any applicable laws or regulations
- Infringe intellectual property rights
- Upload malware, viruses, or harmful code
- Attempt unauthorized system access
- Engage in data mining or scraping
- Use the service for spam or phishing
- Create false or misleading information
- Harass, abuse, or harm others
Content Restrictions
- No hate speech or discriminatory content
- No sexually explicit material
- No violent or threatening content
- No defamatory statements
- No confidential information of others
- No impersonation of individuals/entities
- No false professional credentials
- No content violating privacy rights
Enforcement: Violations may result in content removal, account suspension, termination, and potential legal action. We reserve the right to investigate and take appropriate action against any violations.
7. Content License and Intellectual Property
Your Content Rights and License Grant
You retain all ownership rights to your original content. However, by using our Service, you grant ResumeLoom:
- A worldwide, non-exclusive, royalty-free license to use, store, and process your content
- The right to display your content to you and those you share it with
- The right to create backups and cached versions for service reliability
- The right to analyze aggregated, anonymized data for service improvement
This license terminates when you delete your content or account, except where required for legal compliance or cached/backup copies (which will be deleted within 90 days).
Our Intellectual Property
The Service, including all templates, designs, code, graphics, logos, and functionality, is owned by ResumeLoom and protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or create derivative works of our templates for commercial use
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove any proprietary notices or labels
- Use our trademarks without written permission
- Resell or redistribute our premium templates
Content Moderation and Removal Rights
We reserve the right, but not the obligation, to:
- Monitor, review, or edit user content
- Remove content that violates these Terms or applicable laws
- Suspend or terminate accounts for repeated violations
- Disclose content when required by law or court order
- Preserve content for legal or compliance purposes

11. Limitation of Liability
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESUMELOOM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS OR USE OF THE SERVICE
- INTERRUPTION, SUSPENSION, OR TERMINATION OF SERVICE
- CONTENT OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE
- ANY EMPLOYMENT OUTCOMES OR CAREER DECISIONS
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE (12) MONTHS OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow limitation of certain damages, so some limitations may not apply to you.
12. Indemnification

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.
13. Dispute Resolution and Arbitration
MANDATORY ARBITRATION AGREEMENT

Agreement to Arbitrate
You and ResumeLoom agree that any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, except as otherwise provided herein. This includes disputes arising before the effective date of these Terms.
Arbitration Process
- Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules
- Arbitration will be held in San Francisco, California or via video conference
- The arbitrator's decision will be final and binding
- Each party bears its own costs unless the arbitrator determines otherwise
CLASS ACTION WAIVER
YOU AND RESUMELOOM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Exceptions to Arbitration
- Claims for injunctive or equitable relief regarding intellectual property
- Small claims court actions within its jurisdiction
- Claims that cannot be arbitrated under applicable law
30-Day Opt-Out Right
You may opt out of arbitration by sending written notice to hello@resumeloom.com within 30 days of first accepting these Terms. Include your name, address, and clear statement of opt-out intent.
14. Termination
Termination by ResumeLoom
We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms of Service
- Request by law enforcement or government agency
- Extended period of inactivity
- Non-payment of fees
- Fraudulent or illegal activity
Termination by You
You may terminate your account at any time by:
- Using the account deletion feature in your settings
- Contacting us at hello@resumeloom.com
- Cancelling any active subscriptions
Effect of Termination
Upon termination:
- Your right to use the Service ceases immediately
- We may delete your account and content after 30 days
- Paid subscription fees are non-refundable (except as stated in refund policy)
- Provisions that should survive termination will remain in effect
15. Force Majeure
Neither party shall be liable for any failure or delay in performance under these Terms arising from circumstances beyond its reasonable control, including but not limited to:
- Acts of God, natural disasters, or severe weather
- War, terrorism, riots, or civil unrest
- Government actions, sanctions, or embargoes
- Pandemic, epidemic, or public health emergency
- Labor disputes or strikes
- Infrastructure failures or cyberattacks
The affected party must promptly notify the other party and use reasonable efforts to mitigate the impact.
16. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, and waive any objection to such jurisdiction or venue.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
17. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and ResumeLoom regarding the Service.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that comes closest to the intent of the original.
Waiver
No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision shall not constitute a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction. Any attempted assignment in violation of this section is void.
No Third-Party Beneficiaries
These Terms are for the benefit of the parties only and do not create any third-party beneficiary rights.
Survival
Provisions relating to intellectual property, indemnification, disclaimers, limitation of liability, dispute resolution, and general provisions shall survive termination of these Terms.
18. Changes to Terms
Notification of Changes
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Effective Date" at the top of these Terms
- Send email notification to registered users at least 30 days before changes take effect
- Display a prominent notice on our website and in user dashboards
- Provide a summary of key changes
Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you disagree with the changes, you must stop using the Service and may terminate your account.
19. Export Controls and Compliance
You agree to comply with all applicable export and import laws and regulations. You represent that you are not:
- Located in a country subject to U.S. embargo
- On any U.S. government list of prohibited or restricted parties
- Using the Service for any prohibited end use
